Welcome to Clankr. These Terms of Service ("Terms") govern your access to and use of the Clankr platform, including our website, applications, AI chat services, social features, and any related services (collectively, the "Service"). By accessing or using Clankr, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

1. Eligibility and Account Registration

To use Clankr, you must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher). By creating an account, you represent and warrant that you meet these age requirements and that all registration information you provide is truthful, accurate, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

You may only maintain one account per person. Creating multiple accounts to circumvent restrictions, bans, or usage limits is prohibited and may result in permanent termination of all associated accounts.

2. Use of the Service

2.1 Acceptable Use

You agree to use Clankr only for lawful purposes and in accordance with these Terms. You may:

  • Use AI chat features for personal, educational, professional, and creative purposes.
  • Share content, posts, and stories with other users on the platform.
  • Participate in conferences and collaborative sessions with other users.
  • Customize your profile and interaction preferences.

2.2 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Using the Service for any illegal purpose or in violation of any applicable laws or regulations.
  • Attempting to manipulate, jailbreak, or circumvent the safety measures of our AI systems.
  • Generating, distributing, or sharing content that is harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Creating or distributing malware, spam, or unsolicited commercial messages through the platform.
  • Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
  • Attempting to gain unauthorized access to other users' accounts, our systems, or any connected networks.
  • Using automated bots, scrapers, or other tools to access the Service without our express written permission.
  • Interfering with or disrupting the integrity, security, or performance of the Service.
  • Collecting or harvesting personal information of other users without their consent.
  • Using the Service to generate content that infringes on the intellectual property rights of others.
  • Reselling, sublicensing, or commercially exploiting access to the Service without authorization.

3. AI Services and Limitations

Clankr provides access to artificial intelligence chat services across multiple modes (Direct, Deep, and Ultimate). You acknowledge and agree that:

  • No Guarantee of Accuracy: AI-generated responses may contain errors, inaccuracies, or outdated information. You should not rely solely on AI responses for important decisions, especially in medical, legal, financial, or safety-critical contexts.
  • Not Professional Advice: AI responses do not constitute professional advice of any kind. Always consult qualified professionals for specialized guidance.
  • Content Generation: You are responsible for reviewing and verifying any AI-generated content before using, publishing, or sharing it.
  • Usage Limits: We may impose usage limits on AI features based on your subscription tier. These limits may change with reasonable notice.
  • Model Changes: We may update, modify, or replace the AI models powering our Service at any time to improve quality, safety, or performance.

4. Content and Intellectual Property

4.1 Your Content

You retain ownership of the original content you create and share on Clankr, including text, images, and other materials you upload ("User Content"). By posting User Content on the platform, you grant Clankr a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content solely for the purpose of operating and improving the Service.

You represent and warrant that you own or have the necessary rights to all User Content you post, and that your User Content does not infringe on the intellectual property rights, privacy rights, or any other rights of any third party.

4.2 AI-Generated Content

Content generated by our AI systems in response to your prompts is provided for your use. You may use AI-generated content for personal, educational, and commercial purposes, subject to applicable laws and third-party rights. You acknowledge that similar AI outputs may be generated for other users who provide similar prompts, and that AI-generated content does not constitute unique intellectual property.

4.3 Our Intellectual Property

The Service, including its design, features, code, AI models, branding, logos, and all related intellectual property, is owned by Clankr and protected by copyright, trademark, and other applicable laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.

5. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

You agree not to share sensitive personal information (such as social security numbers, financial account details, or medical records) through AI chat conversations. While we implement strong security measures, AI chat features are not designed for the transmission of highly sensitive data.

6. Subscription and Payment Terms

Clankr offers both free and premium subscription tiers. If you choose a paid subscription:

  • Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your chosen plan). All fees are non-refundable except as required by applicable law.
  • Price Changes: We may change subscription prices with at least 30 days' prior notice. Price changes will take effect at the start of your next billing cycle.
  • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period, and you will retain access to premium features until that date.
  • Free Tier: The free tier includes limited access to AI features and may display advertisements. Free tier features and limits may change at our discretion.

7. Content Moderation and Enforcement

We reserve the right to review, moderate, and remove any content that violates these Terms, our community guidelines, or applicable laws. We may take enforcement actions including but not limited to:

  • Removing or hiding violating content.
  • Issuing warnings to users who violate our policies.
  • Temporarily or permanently suspending accounts.
  • Limiting access to specific features or services.
  • Reporting illegal activities to appropriate law enforcement authorities.

We strive to enforce our policies fairly and consistently, but we are under no obligation to monitor all content on the platform. Users are encouraged to report violations through our reporting tools.

8. Disclaimers and Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLANKR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY AI-GENERATED CONTENT OR RESPONSES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR INFORMATION.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Clankr and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.

10. Termination

You may terminate your account at any time by deleting it through your account settings or by contacting our support team. We may terminate or suspend your access to the Service immediately, without prior notice, if we determine that you have violated these Terms or if your continued use poses a risk to the Service, other users, or third parties.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration or in the courts of competent jurisdiction, as permitted by applicable law.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action, to the extent permitted by applicable law.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the Service or via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

13. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Clankr regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Clankr is incorporated, without regard to conflict of law principles.
